Welcome to the website of Armed Forces Support Foundation (“AFSF,” “we,” “us,” or “our”), a 501(c)(3) nonprofit organization (Tax ID/EIN: 46-3102037) serving veterans in Kern County, California. These Terms of Use (“Terms”) govern your access to and use of www.armedforcessupport.org (the “Site”), including our contact form, assistance application forms, and donation features.

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

1. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use of the Site by, any other person. You may not use the Site to transmit any material that is unlawful, harassing, defamatory, or fraudulent, or to attempt to gain unauthorized access to any portion of the Site, its servers, or connected systems.

2. Assistance Programs and Applications

AFSF provides financial and non-financial assistance to eligible veterans as resources allow. By submitting an assistance or grant application, you acknowledge and agree that:

  • Submission of an application does not guarantee assistance of any kind or amount.
  • All assistance decisions are made at the sole discretion of AFSF and its board, based on eligibility, documented need, and available funding.
  • You will provide truthful, accurate, and complete information. Providing false or misleading information is grounds for denial of assistance and may be reported where required by law.
  • AFSF may request supporting documentation, including proof of military service, and may verify the information you provide.
  • Approved assistance may be paid directly to third parties (such as a landlord or utility provider) rather than to the applicant, at AFSF’s discretion.
  • AFSF may decline, discontinue, or modify any assistance program at any time without notice.

3. Donations

Donations to AFSF are processed through Square, a third-party payment processor, and are subject to Square’s own terms and privacy policy. By donating, you represent that you are authorized to use the payment method provided. Donations are voluntary charitable contributions and are generally non-refundable. If you believe a donation was made in error or without authorization, contact us promptly at info@armedforcessupportfoundation.org and we will review the request in good faith.

AFSF is a 501(c)(3) organization and contributions are tax-deductible to the extent permitted by law. No goods or services are provided in exchange for donations unless otherwise stated. Please consult your tax advisor regarding the deductibility of your contribution.

4. Intellectual Property

All content on the Site, including text, graphics, logos, images, and the AFSF name and marks, is the property of AFSF or its licensors and is protected by applicable intellectual property laws. You may view and print Site content for personal, non-commercial purposes. You may not reproduce, modify, distribute, or use the AFSF name, logo, or content for any other purpose, including fundraising conducted in AFSF’s name, without our prior written permission.

5. User Submissions

By submitting information through the Site, including through the contact form or an assistance application, you represent that the information is accurate and that you have the right to provide it. Handling of personal information is governed by our Privacy Policy.

6. Third-Party Websites and Services

The Site contains links to third-party websites and services, including our Square donation checkout and our social media pages. These are provided for convenience only. AFSF does not control and is not responsible for the content, policies, or practices of any third-party site or service. Your use of third-party sites is at your own risk and subject to their terms.

7. Disclaimer of Warranties

The Site and all content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AFSF does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Information on the Site is provided for general informational purposes and does not constitute legal, financial, medical, or benefits advice.

8. Limitation of Liability

To the fullest extent permitted by law, AFSF, its directors, officers, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, any assistance application or decision, or any donation, even if advised of the possibility of such damages. In no event shall AFSF’s total liability to you for all claims exceed one hundred dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless AFSF and its directors, officers, employees, and volunteers from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Site.

10. Changes to the Site and These Terms

We may modify, suspend, or discontinue any part of the Site at any time. We may also update these Terms from time to time. Changes take effect when posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of these Terms or your use of the Site shall be resolved in the state or federal courts located in Kern County, California, and you consent to the jurisdiction of those courts.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
